Acceptance of Terms

By accessing and using www.essentialhealing.com (the "Website"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Website.

These Terms apply to all visitors, users, and others who access the Website or purchase services ("Clients").

Services Provided

Essential Healing Inc. provides Therapeutic Coaching, Rapid Transformational Therapy (RTT), and educational resources.

  • Scope: You understand that these services are designed for educational and self-improvement purposes.

  • No Medical Status: You acknowledge that Essential Healing Inc. is not a medical or mental health facility. The services provided are not a substitute for professional medical advice, diagnosis, or treatment.

Intellectual Property Rights

The content on this Website, including but not limited to text, graphics, logos, images, audio recordings (hypnosis tracks), worksheets, course materials, and software, is the property of Essential Healing Inc. and is protected by Canadian and international copyright laws.

You agree that:

  • You may view and download materials for your personal, non-commercial use only.

  • You will not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

  • Specific to RTT: Audio recordings provided during sessions are for the exclusive use of the specific client. Sharing these recordings with others is strictly prohibited.

User Conduct

By using this Website, you agree not to:

  • Use the Website for any unlawful purpose.

  • Harass, abuse, or harm another person via our contact forms or social media channels.

  • Attempt to gain unauthorized access to our secure areas (e.g., client portals).

Payment, Refunds, and Cancellations

  • Payment: Payment for coaching packages or RTT sessions is due in full prior to the start of the service, unless a payment plan has been agreed upon in writing.

  • 24-Hour Cancellation Policy: If you need to cancel or reschedule a session, you must provide at least 24 hours' notice. Missed appointments or cancellations with less than 24 hours' notice will be charged the full session fee.

  • Refund Policy:

    • Services: Due to the nature of time-based services, no refunds will be issued for Coaching or RTT sessions that have already been provided.

    • Digital Products: Due to the immediate downloadable nature of digital products (e.g., pre-recorded courses or audios), all sales are final and non-refundable.

Third-Party Links

Our Website may contain links to third-party websites or services (e.g., book recommendations, affiliate links) that are not owned or controlled by Essential Healing Inc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

Limitation of Liability

To the maximum extent permitted by applicable law in Alberta, in no event shall Essential Healing Inc., its directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

Liability Cap: In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Essential Healing Inc. in the last six (6) months, or $100 CAD, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Essential Healing Inc. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

  • Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be resolved in the courts of Calgary, Alberta.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
